Privacy Policy

1. Who we are

Don't Miss A Call (“DMAC”, “we”, “us”) is a service operated by Orion Ground Control Pty Ltd, an Australian business based in Perth, Western Australia. We provide an AI SMS receptionist for Australian tradies. This policy explains what personal information we collect, how we handle it, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Our commitment

Although our current annual turnover is below the $3 million threshold that mandates compliance with the Privacy Act, we voluntarily handle personal information in accordance with the 13 Australian Privacy Principles.

3. Information we collect

From tradies (our customers): name, business name, trade type, email, mobile number, payment details (handled by Stripe — we never store full card numbers), billing history, settings and preferences you configure.

From people who contact your business: phone number, the content of SMS messages they send to your forwarding number, the content of voice calls made to that number (we play a short greeting; we do not record voice calls), and any information they voluntarily share during the AI SMS conversation (name, suburb, job description, etc.).

Technical data: IP address, browser and device information, and basic analytics on how the dashboard is used.

4. How we use it

  • To operate the Service: route forwarded calls, send SMS replies, store lead transcripts, notify tradies of new leads
  • To bill you (via Stripe) and manage your subscription
  • To power AI conversations (via Anthropic's Claude). Message content is sent to Anthropic for response generation; Anthropic does not train on this data per their commercial terms
  • To improve the Service through aggregate, non-identifying analysis
  • To respond to support requests, send service-related emails, and comply with our legal obligations

5. Sub-processors and overseas data transfer (APP 8)

We use the following third-party service providers (“sub-processors”) to deliver the Service. Some are based overseas. By using DMAC, you consent to your personal information being transferred to and processed in the jurisdictions listed below.

We take reasonable steps to ensure each sub-processor handles personal information in accordance with the APPs, primarily by selecting providers that operate under the EU's GDPR or comparable privacy frameworks, and by reviewing each provider's published privacy and security commitments.

We never sell personal information to third parties.

6. SMS consent and opt-out (Spam Act 2003)

When someone calls a tradie's business number and we reply via SMS, the message identifies the sending business and includes a “Reply STOP to opt out” notice. We honor the keywords STOP, UNSUB, UNSUBSCRIBE, END, QUIT, CANCEL, OPT OUT, and NO — replying with any of these immediately removes your number from that business's SMS list. You will receive one confirmation SMS and no further commercial messages from that business. Opt-outs are per-business; replying STOP to one tradie does not affect any other tradie using the platform.

7. Data retention

Lead transcripts are retained while the relevant tradie's account is active and for up to 12 months after cancellation, after which they are permanently deleted. Billing records are retained for 7 years to meet Australian tax law requirements. You may request earlier deletion of personal information about you by emailing the address below.

8. Your rights

Under the Privacy Act and the APPs you have the right to:
  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your personal information (subject to legal retention obligations)
  • Withdraw consent for marketing communications at any time
  • Lodge a complaint with the Office of the Australian Information Commissioner (OAIC) if you believe we have mishandled your information — oaic.gov.au

9. Security

Personal information is encrypted in transit (TLS 1.2+) and at rest (AES-256 via our database provider). Access to production data is restricted to authenticated administrators using strong passwords and multi-factor authentication. We follow industry-standard practices for password handling (hashed, never stored in plaintext) and credential rotation.

10. AI disclosure

Conversations with our SMS receptionist are generated by an AI assistant (Anthropic's Claude). The AI does not pretend to be human. If a caller asks directly whether they are speaking with a person or a bot, the AI will disclose that it is an AI assistant and that the business owner will be in touch personally.

11. Data breach notification

Where a data breach occurs that is likely to result in serious harm to affected individuals, we will notify the OAIC and affected individuals as soon as practicable, in accordance with the Notifiable Data Breaches scheme under the Privacy Act.

12. Children

The Service is intended for use by Australian businesses and is not directed at anyone under the age of 18. We do not knowingly collect personal information from children.

13. Changes to this policy

We may update this policy from time to time. Material changes will be notified to active customers by email at least 14 days before they take effect. The “Last updated” date at the top of this page reflects the most recent revision.
